4-3-10 Permit to Move Buildings or Structures

(A)    It shall be unlawful to move any building on, to or over a public street or alley without first obtaining a permit from the department of buldings.  The application shall show the size and height of the building, the route to be taken, the wiring, posts, etc., that will require moving and replacing along with an itemized statement of such costs.  If, after consideration by the building committee, the moving of the building appears feasible, and evidence of proper agreements with all utility companies affected as well as permits from the gency in control of ny state or county highway to be used or occupied, is submitted, the permit will be issued providing that in addition to the payment of the proper moving permit fee, a surety bond shall be approved and filed with the chairman of the building committee, said bond shall hold harmless the village from any damage arising out of the moving of the building and the application shall further show evidence of adequate insurance to cover any damages incurred in the moving. (B)    The amount of fee to be charged for moving a building on or over a public street or alley is to be based on the size of the building and the distance it is moved, and shall be determined by the building committee.  The minimum fee shall be two hundred dollars ($200.00).

(C)    There shall be a charge made for water used in construction.  Water shall be used from a service installed by the owner.  Under no circumstances shal water be taken from fire hydrants.  The charge for water used shall be forty dollars ($40.00) for a single-famil building and twenty dollars (420.00) per unit for multi-family construction.  A fee shall be set by the superintendent of buildings for any other type of contruction.  (Ord. 1232, 9-11-1991)

4-3-5 Permit Does Not Allow Violation

The issuance of a permit does not allow violations of any of the requirements or provisions of the building or zoning code, even if shown by plans or other documents but not corrected by the superintendent of buildings or building chairman when application was made, nor the village, its department of buildings or officers liable for the cost to make such building or structure comply with the building or zoning code. 4-2-5 DEPUTIES OF THE DEPARTMENT OF BUILDINGS

The Chiefs of the Fire and Police Departments, Village Engineer, Health Inspector, Superintendent of Public Works and the Village Attorney are hereby made ex officio deputies of the Department of Buildings, and shall aid the Superintendent of Buildings in administering and enforcing the provisions of this Code.  (Ord. 1233, 9-25-1991)
