(D) Building Permit Fees

1. Building permit fees are established and shall be collected from the builder at the time a building permit is issued. The fee shall be as follows:

(a) Basic fee: $15.00

(b) For each additional $1,000.00 or fraction thereof over $1,000.00 valuation: $15.00 per thousand

(E) Penalties: Penalties for work performed without a permit:

1. Contractor: Double the regular permit fee for performing the work;

2. Resident/Owner/Tenant: Penalty set by the superintendent of buildings. Maximum fee not to exceed double the regular permit fee for performing the work. (Ord. 1569, 4-9-2003)

1-19-8 PENALTIES

(A)    A person who intentionally violates any provision of Section 1-19-2 of this chapter may be punished by a term of incarceration in a penal institution other than a penitentiary for a period of not more than three hundred sixty four (364) days, and may be fined in an amount not to exceed two thousand five hundred dollars ($2,500.00)

(B)    A person who intentionally violates any provision of Section 1-19-3 or 1-19-5 of this chapter is subject to a fine in an amount of not less than one thousand one dollars ($1,001.00) and not more than five thousand dollars ($5,000.00).

(C)    Any person who intentionally makes a false report alleging a violation of any provision of this chapter to the local enforcement authorities, the state’s attorney or any other law enforcement official may be punished by a term of incarceration in a penal institution other than a penitentiary for a period of not more than three hundred sixty four (364) days, and may be fined in an amount not to exceed two thousand five hundred dollars ($2,500.00)

(D)    A violation of Section 1-19-2 of this chapter shall be prosecuted as a criminal offense by an attorney for the village by filing in the circuit court and information, or sworn complaint, charging such offense.  The prosecution shall be under and conform to the rules of criminal

A violation of section 1-19-3 or 1-19-5 of this chapter may be prosecuted as a quasi-criminal offense by an attorney for the village, or if an ethics commission has been created, by the commission through the designated administrative procedure.

(E)    In addition to any other penalty that may be applicable, whether criminal or civil, an officer or employee who intentionally violates any provision of section 1-19-2, 1-19-3, or 1-19-5 of this chapter is subject to discipline or discharge. (Ord. 1595, 5-26-2004)

4-2-6 DUTIES AND POWER OF SUPERINTENDENT OF BUILDINGS

The Superintendent of Buildings shall be the head of the Department of Buildings and have general charge of inspection, supervision and enforcement of all matters pertaining to buildings or structures as set forth in this Code.  He shall, initiate or when requested by the President of the Board of Trustees or the Building Committee, make investigations in connection with matters referred to in this Code; also make or case to be made investigations on new materials and modes of construction intended for use in the construction of buildings not provided for in this Code and make written reports with his recommendations to the President of the Village Board and to the Building Committee.  He shall keep accurate records of all applications, permits and other matters pertaining to this office and make a report to the chairman of the Building Committee each month of any and all business transacted by this Department.  It is within the power of said Superintendent of Buildings to approve or reject the following:

(A)    Applications for permits to erect or remodel buildings or structures for any occupancy ro type of construction not provided for in this Code.

(B)    The location or width of, or increate in the number of stairs or exit doors if the location or number shown on plans would create a risk of life in case of fire.

(C)    The architectural design of buildings or structures based on architectural harmony with existing buildings or structures.

(D)    Al applications for building permits, all business license applications where a Building Department inspection is required for approval. (Ord. 1233, 9-25-1991)

(E)    Any request for a building code or fire code variation shall be made to the Superintendent of Buildings for his approval or rejection.  Said request must be made in writing and said request must explain the basis for the request and is to be accompanied by cash or certified check in the amount of seventy five dollars ($75.00) which shall be delivered to the Treasurer to the credit of the General Fund of the Village to cover the approximate administrative cost of the procedure and the paperwork involved.  Under no circumstances shall this sum of money or any part thereof be refunded to the applicant. In case of any violations of the provisions of this Code, the Superintendnet and/or any authorized inspectors shall immediately notify the owner of the property in question and/or the contractor or workmen present at the building site as to what violation exists, and shall instruct that the violation be corrected forthwith.  In the event that the violation is not corrected, the Superintendent and/or any authorized inspectors, shall issue and post a stop order on all construction work.  Any violation which is not corrected or any continuation of work after the posting of a stop shall be subject to the penalties as prescribed by Village ordinances.
